TERMS & CONDITIONS

Operator: Movement Nation 2020 Pty Ltd ("Movement Nation", "we", "us", or "our")
By accessing or using our website, services, and studio facilities (collectively referred to as "Services"), you agree to be legally bound by the terms outlined below. If you do not agree, you must immediately refrain from using our Services.
1. Acceptance and Amendments
We may update these Terms at any time without prior notice. Your continued use of our Services constitutes acceptance of any changes. It is your responsibility to review these Terms regularly.
2. Eligibility and Enrolment

  • Minimum age to join is 18. Youth Members (3–17) may join with parental/legal guardian consent and agreement to Special Conditions.

  • Memberships and passes (e.g., Class Passes) are subject to specific expiry terms and extension fees, as outlined during enrolment.

  • A Pre-Enrolment Questionnaire must be completed and truthful to ensure safe participation.

3. Health, Safety, and Conduct

  • You must ensure you are physically and medically fit for participation. Always seek medical advice if unsure.

  • Participation is at your own risk. Movement Nation is not liable for injuries or health issues arising from the use of Services.

  • You must not attend classes if unwell or under the influence of drugs or alcohol.

  • Illegal substances and unsanctioned commercial activities are prohibited in or around the studio.

  • Movement Nation may suspend or cancel your membership for any breach of these terms.

4. Studio Access and Rules

  • Access is via valid booking confirmation. Do not share access credentials or allow others into the studio.

  • Always follow studio staff directions and safety procedures.

  • Orientation may be required before using facilities or equipment.

  • Misconduct may result in membership suspension or termination.

Studio Rules include:

  • Respect staff, members, and property.

  • Maintain hygiene and clean up after use.

  • Do not bring valuables; we are not responsible for lost or stolen items.

  • Always act safely and responsibly.

5. Risk and Liability

  • You assume all risks associated with physical activity.

  • You waive any claims against Movement Nation, its owners, employees, and agents for injury, death, loss, or damage arising from participation or use of our facilities.

  • This waiver extends to your family, heirs, and assigns.

6. Privacy and Data

  • Your personal data is collected and used in accordance with our Privacy Policy (see: Movement Nation Privacy Policy).

  • Your data may be transferred outside Australia and stored securely.

  • By participating, you consent to our use of photographs, videos, and recordings for promotional purposes.

7. Intellectual Property

  • All content (text, images, logos, media) on our website is owned or licensed by Movement Nation.

  • You may not copy, reproduce, or distribute any content without prior written consent.

8. Online and Zoom Classes

  • Online participation carries additional risks due to the lack of in-person supervision.

  • Movement Nation is not responsible for injuries occurring during virtual classes.

9. Payments and Fees

  • Membership and class fees must be paid in full and on time.

  • Non-payment may result in suspension or termination.

  • Fees may increase after the minimum term with at least 7 days’ notice.

10. Cancellation and Refunds

  • You may cancel within 48 hours of enrolment with written notice.

  • Cancellation for medical reasons requires a doctor’s certificate and may incur an administrative fee.

  • After the minimum term, cancellation requires 30 days’ written notice.

  • Pre-booked classes can be rescheduled or cancelled with 24 hours’ notice.

  • Unused packages are non-refundable, but extensions may be granted at our discretion.

11. Changes to Services

  • We may modify, suspend, or discontinue any aspect of the Services at any time.

  • We are not responsible for service interruptions beyond our control (e.g., natural disasters).

12. Indemnification
You agree to indemnify and hold harmless Movement Nation and its affiliates from all claims, losses, damages, liabilities, and expenses (including legal fees) arising from your breach of these Terms or misuse of the Services.
13. Third-Party Services

  • Our Services may include links or references to third-party content. We are not liable for any third-party actions, services, or policies.

14. Governing Law
These Terms are governed by the laws of New South Wales, Australia. Any disputes shall be resolved under the jurisdiction of its courts.
